Throughout the site, the terms “we,” “us,” and “our” refer to Gross Fine Art.

By visiting our website and/or purchasing an artwork from us, you agree to be bound by these Terms of Service, together with our Privacy Policy, Shipping Policy, and Returns & Cancellations Policy.

If you do not agree to these terms, please do not use the website or purchase products from us.

Online Store Terms

You may use our website only for lawful purposes.

You may not use our products, website, content, images, or services for any illegal or unauthorized purpose.

You agree not to interfere with, disrupt, damage, or attempt to gain unauthorized access to the website, its systems, or any related services.

Artwork and Product Information

Gross Fine Art specializes in original, one-of-a-kind artworks.

We make reasonable efforts to display artwork images, colors, dimensions, descriptions, and other details as accurately as possible.

However, colors may appear differently depending on screen settings, lighting, photography, or device display.

Minor variations in texture, brushwork, color, or surface appearance are natural characteristics of original handmade artwork and are not considered defects.

Artwork dimensions are provided as accurately as reasonably possible.

One-of-a-Kind Availability

Each original artwork is unique and generally available in a single unit only.

Adding an artwork to your cart does not reserve it.

An artwork is considered sold only after payment has been successfully completed and the order has been confirmed.

In the rare event that the same artwork is sold simultaneously through another sales channel or is otherwise unavailable after an order has been placed, Gross Fine Art reserves the right to cancel the order and issue a full refund.

Prices and Payment

All prices displayed on the website are shown in the currency selected or displayed at checkout.

Prices may be changed at any time without prior notice, but changes will not affect orders that have already been confirmed.

Payment must be successfully completed before an order is processed.

We reserve the right to refuse or cancel an order where payment cannot be verified, where fraud is suspected, or where incorrect pricing or product information has been displayed due to an error.

Taxes, Customs and Import Charges

For orders shipped within Israel, applicable taxes will be handled in accordance with Israeli law and the tax status of the business.

For international orders, customers are responsible for all customs duties, import taxes, VAT, brokerage fees, clearance fees, and other charges imposed by the destination country.

These charges are not included in the artwork price or shipping cost unless explicitly stated otherwise.

Gross Fine Art does not control these charges and cannot predict their amount.

Shipping and Delivery

Orders are prepared and shipped in accordance with our Shipping Policy.

Customers are responsible for providing complete and accurate shipping information.

Estimated processing and delivery times are estimates only and may be affected by courier delays, customs, holidays, weather conditions, or other circumstances outside our reasonable control.

Where applicable, artworks may be shipped as rolled canvases without wooden stretcher frames.

The customer is responsible for arranging stretching, mounting, or framing after delivery unless otherwise stated.

Returns, Refunds and Cancellations

Returns, refunds, and cancellations are governed by our Returns & Cancellations Policy.

Customers may request a return within the period stated in that policy, subject to applicable mandatory consumer protection laws.

Nothing in these Terms limits any consumer rights that cannot legally be waived.

Damaged or Lost Shipments

Customers must notify us as soon as reasonably possible if an artwork arrives damaged or if a shipment appears to be lost.

Customers may be required to provide photographs of the artwork, packaging, shipping label, and visible damage.

Customers should retain all original packaging until the matter has been resolved.

Claims relating to shipping damage or loss may also be subject to the procedures and requirements of the shipping carrier.

Intellectual Property

All content appearing on this website, including artwork images, photographs, logos, text, branding, graphics, and website content, is owned by Gross Fine Art, the artist, or the applicable rights holder, unless otherwise stated.

Purchasing an original artwork transfers ownership of the physical artwork only.

The purchase does not transfer copyright, reproduction rights, commercial usage rights, image rights, or any other intellectual property rights unless expressly agreed in writing.

You may not reproduce, copy, distribute, publish, sell, license, commercially exploit, or otherwise use images of the artworks or website content without prior written permission.

Personal and Commercial Use of Purchased Artwork

Unless otherwise agreed in writing, purchased artwork is intended for private ownership and display.

Ownership of the physical artwork does not grant permission to reproduce the artwork for commercial products, advertising, merchandise, NFTs, prints, digital distribution, or other commercial purposes.

Accuracy of Information

We make reasonable efforts to ensure that the information on our website is accurate and current.

However, occasional errors, inaccuracies, or omissions may occur in product descriptions, prices, availability, shipping information, or other content.

We reserve the right to correct errors, update information, or cancel an affected order where reasonably necessary.

Third-Party Services

Our website may use or link to third-party services, including payment processors, shipping providers, Shopify, and other service providers.

We are not responsible for the content, availability, privacy practices, or actions of third-party websites or services, except where responsibility cannot legally be excluded.
